Registering as a charity

An organisation is a charity if it is established exclusively for charitable purposes.

Organisations that meet conditions for charitable status are required to apply for registration under the Charities Act 1993. However, organisations with charitable objects are charitable even if they are not registered with the Charity Commission.

Organisations seek charitable status for the benefits it brings including credibility, public image and tax relief. The new Charities Act 2006 has introduced a clearer definition of what is charitable, with an emphasis on demonstrating the public benefit of a charity's aims and activities.  Also the types of charitable purposes that an organisation's activities have to fall within have been expanded from four headings, or purposes, to 12 specific headings  and one general heading.

Not all voluntary and community organisations register as a charity. Some alternative legal structures.  It depends what is most suitable to the organisation's activities.

Registration

Organisations can download or order a Registration Application Pack from the Charity Commission.

The Charity Commission also provides a range of publications that cover all aspects of charity law including how to register, what is required once registered, financial accounting requirements and the responsibilities of trustees.

The registration process may seem complicated. Remember that second tier organisations can provide information, advice and support on setting up a charitable organisation.

There are legal services and publications that specialise in Charity Law which are available to voluntary and community organisations. It's a good idea to check with an advisor or a solicitor with experience of the voluntary sector if you are unsure about how the Charity Act applies to your organisation.
